Terms and Conditions for Kahawa Time

Effective Date: February 1, 2025

Welcome to Kahawa Time ("the Platform"). By accessing or using the Platform, you agree to comply with and be bound by the following Terms and Conditions. If you do not agree with these terms, you may not use our services.

1. Definitions

Platform: Refers to the Kahawa Time application and its associated services.
User: Any person accessing or using the Platform, including Authors and Readers.
Author: A user who writes and publishes stories on the Platform.
Reader: A user who accesses and reads stories on the Platform.
Coins: The virtual currency used on the Platform, equivalent to 1 Tanzanian Shilling (TZS).
Escrow Account: An intermediate account where payments are held for 24 hours before being credited to the Author's account.

2. Eligibility

Users must be at least 18 years old or have parental/guardian consent to use the Platform. By using the Platform, you affirm that you are legally able to enter into these terms.

3. Author Obligations

Authors are responsible for ensuring that all content they publish complies with the laws and regulations of Tanzania.
Authors must refrain from posting:
- Hate speech, defamatory, obscene, or offensive content.
- Plagiarized material.
- Content inciting violence, discrimination, or illegal activities.
Authors agree that all payments earned will be credited in Coins and can only be withdrawn by the Author to their own account. Funds are held in escrow for 24 hours after a purchase.

4. Reader Obligations

Readers must respect other users, including Authors and other Readers, in all interactions on the Platform, including reviews and comments.
Abusive, hateful, or inappropriate language is strictly prohibited.

5. Coins and Payments

Coins are the exclusive currency on the Platform, equivalent to 1 TZS.
Readers can purchase Coins to access premium episodes or stories through in-app purchases.
Authors receive 75% of the revenue generated from their paid content, while Kahawa Time retains 25%.
The 25% retained by Kahawa Time is used to cover service maintenance costs, including transaction fees, withdrawal transaction fees, infrastructure costs, and other operational expenses.
Funds are transferred to an escrow account for 24 hours before being credited to the Author’s account.
Coins are non-transferable and non-refundable. Only Authors can withdraw earnings, subject to the escrow holding period.

6. Platform Rules

Users must not:
- Use the Platform for illegal or unauthorized purposes.
- Distribute viruses, malware, or engage in any activity that disrupts the Platform’s functionality.
Any breach of these rules may result in suspension or termination of the account.

7. User-Generated Content

All content posted by Authors and Readers is considered user-generated content. Kahawa Time does not pre-screen, endorse, or take responsibility for the accuracy, legality, or quality of such content.
Users are solely responsible for the content they post on the Platform.
Kahawa Time is not liable for any disputes, damages, or issues arising from user-generated content. However, we reserve the right to remove content that violates these Terms and Conditions or applicable laws.

8. Content Ownership

Authors retain ownership of their original content.
By publishing content on the Platform, Authors grant Kahawa Time a non-exclusive, royalty-free license to display, distribute, and promote their stories.

9. Refunds and Disputes

Refunds are not provided for Coins purchased or content accessed.
Disputes regarding content or payments will be resolved at Kahawa Time's sole discretion.

11. Termination of Service

Kahawa Time reserves the right to suspend or terminate a User's account for any violation of these Terms and Conditions or for any activity deemed harmful to the Platform or its users.

12. Limitation of Liability

Kahawa Time is not liable for any damages arising from:

Loss of earnings or content.
Misuse of the Platform by other users.
Technical issues beyond our control.

13. Privacy Policy

All personal data collected on the Platform is handled in accordance with our Privacy Policy, which can be accessed at privacy policy page.

14. Governing Law

These Terms and Conditions are governed by the laws of Tanzania. Any disputes will be resolved under Tanzanian jurisdiction.

15. Amendments

Kahawa Time reserves the right to update these Terms and Conditions at any time. Users will be notified of significant changes.
